Legal Links

What are the "Legal Links"?

The "Legal Links" are a conundrum of links for various legal issues revolving around the FMLA and discrimination. The first links that will be posted are Department of Labor Opinions. There will be a total of 113 opinions posted. These opinions will be posted in .gif (picture) format, page by page, and in .pdf (Acrobat Reader) format which will be one file for all pages of an opinion. There are separate point of entries for both formats. Those entry points are listed below.

Summaries for the above are not provided and it is not foreseen that they will be provided.  Note that DOL has a website that are dedicated to the DOL opinions.  They can be found at DOL FMLA Opinions.  Of the 113 opinions that are provided on this site, only a certain number remain on the DOL site.  I would tend to believe that some of those opinions were overturned in court, some were re-addressed by the DOL, and some may have been erroneous to begin with.

The MSPB Links

The Merit Systems Protection Board (MSPB) links listed below provide hyperlinks to recent MSPB cases and the MSPB main page which has a search engine capability to locate various MSPB decisions. The links are not complete, and only the most recent decisions are in the "recent MSPB cases" page.  These pages will no longer be updated.  To view recent MSPB decisions, please go to the MSPB home page.  Recent decisions, as well as specific decisions, can be located at their home page utilizing the available search capability contained therein.

The EEOC Links

The below listed link takes you to the EEOC website and the search engine to search for EEOC cases. The cases listed will be final decisions to any appeals, or requests for reconsideration. The cases will not list any interim appeals that are submitted by any party.

A Case Study - Discrimination at its Extreme

The below listed link takes you to a web page that will give you access to an Extreme case of discrimination by the USPS. It is a lengthy EEOC decision, but one worth your effort to see what capabilities the USPS has in discriminating against an individual with a disability
